According to the presented initiatives, it is planned to introduce four types of lawsuits instead of one existing, as well as review the established six-month period for filing applications. It is proposed to give citizens the opportunity to file lawsuits to recognize the violation of legislation by a state body without time limits.

In addition, citizens are intended to be allowed to directly appeal to the court against acts of state authorities in the field, if they violate their rights. It is also proposed to empower administrative courts with the right to verify the legality and validity of the application by officials of discretionary powers when imposing measures of influence on business and citizens.

In terms of enforcing court decisions, a measure is envisaged: if an official after being fined again fails to execute the verdict, the court sends a notification to the prosecutor. The head of state supported the presented initiatives.

According to the report, since July 1, 2017, the administrative courts of the country have considered about 150 thousand cases, canceled more than 70 thousand decisions of state bodies and issued about 27 thousand private definitions.

What it means

In the event of the adoption of changes, citizens will be able to apply to the court without a six-month time limit to recognize the actions of state bodies as illegal and directly challenge the decisions of local authorities.
